Article 1 – APPLICABLE REGULATIONS
These general conditions of use, which may be modified on an ad hoc basis, apply to all our services, available directly online, by e-mail or by telephone.
These general conditions form an integral part of the accommodation contract, which is subject to the status of Tourist Residences. Consequently, the legal provisions relating to residential leases are not applicable, in particular as regards those relating to the maintenance in the premises, any domiciliation being strictly prohibited.
Any CLIENT of the residence CALM APPART HOTEL is deemed to have taken notice during the process of its renting of an apartment, these General Conditions of Sale and accept them unconditionally.
Article 2 – RESERVATION
The reservation of an apartment in the residence CALM APPART HOTEL can be done directly with the reception, on the spot or by telephone, or online via the site “www.calm-apparthotel.com”.
The reservation can only be registered if the CUSTOMER has clearly identified by filling in all the mandatory fields.
The reservation of an apartment in the CALM APPART HOTEL residence is valid only after acceptance of the client’s reservation by CALM APPART HOTEL and remains at its sole discretion.
In addition, the reservation must, to be firm, be guaranteed by a credit card issued by a deemed establishment and valid or by the payment of a deposit.
The abovementioned deposits must correspond to one night for any reservation up to 6 nights and 30% of the total amount of the stay for stays longer than 7 nights.
Article 3 – PAYMENT TERMS
Invoices issued by the residence must be paid immediately upon presentation. On the day of the arrival of the client, CALM APPART HOTEL will claim the payment of his stay. With the exception of stays of more than 15 days whose invoices will be issued and presented every 15 days at the beginning of the period.
In case of extension of stay, the price of the new period is payable in advance. Early departure does not give rise to any refund and may result in a change of fare. No discount is applied for prepayment. Optional benefits are payable in advance. In case of non-payment of the invoices on their due dates, CALM APPART HOTEL will be entitled to a monthly interest of delay equivalent to 3 times the amount of the legal interest. In cases where it has been agreed that payment of a customer’s stay will be made by a third party, the customer will remain personally liable for the payment in question.
Article 4 – PRICE
Prices are quoted in EUROS. The prices are inclusive of all taxes and include the provision of the apartment charges included (water, electricity, heating), with the exception of the tourist tax, payable directly on site. Optional services are not included in the price.
Article 5 – DURATION OF THE STAY (MODIFICATION OF RESERVATION OR DURATION)
The length of stay is as specified in the booking confirmation or in the accommodation offer.
The duration of the stay can be extended subject to availability and at discretion of CALM APPART HOTEL, without obligation to maintain in the same apartment, nor at the same rate.
In the event of an extended stay and the application of a new tariff, this will apply from the signature of the new contract corresponding to the new accommodation period.
In case of early departure from the date scheduled for booking, the applicable rate will be that corresponding to the length of stay.
Article 6 – CANCELLATIONS / NOT PRESENTATIONS
Cancellations received 48 hours prior to the scheduled arrival date will not be subject to cancellation fees.
Any cancellation received 24:00 before the scheduled arrival date will be subject to an equal cancellation fee :
– ½ night (plus taxes) for stays of less than 7 nights,
– one night for stays longer than seven nights.
Any cancellation received less than 24 hours before the scheduled arrival date will be subject to an equal cancellation fee :
– a night (plus taxes) for stays of less than seven nights,
– two nights (plus taxes) for stays longer than seven nights,
Failure to arrive (reservation) in case of no cancellation will be deemed a “no show” and will be subject to the aforementioned cancellation fee.
Article 7 – ARRIVAL AND DEPARTURE
The codes are handed over from 15:00 on the day of arrival.
Unless expressly stated otherwise, the CLIENT must leave the room before 11:00 am on the day of the end of the reservation. Otherwise, he will be charged an additional night.
Article 8 – CUSTOMER OBLIGATIONS AND INVENTORY
The apartment will be put at the disposal of the resident in a good state of maintenance. The CUSTOMER will use the rented premises and their items of equipment in “good father of family”.
The CLIENT will make a peaceful use of the room or the apartment placed at its disposal and will behave in a way to respect the tranquility of the other occupants of the residence.
The CUSTOMER agrees to comply with the provisions hereof and with the rules of procedure of the establishment which he will find posted in his room.
The CUSTOMER refrains not to elect domicile at the address of the establishment, neither on the fiscal level nor professionally, nor to lend, sublet, in any capacity whatsoever, the room or the apartment, Apartment to a third party.
The CUSTOMER will take care of his personal effects and will take all the usual precautions with regard to his own property.
The CUSTOMER agrees to retain the movable property placed at his disposal in the room or apartment in good general condition and shall declare on receipt any defect or malfunction.
An inventory and an inventory of the situation appear in each apartment. The CUSTOMER assumes responsibility for verifying its contents and to notify the reception of any anomalies, missing or degraded elements within a period of two hours from the first opening of its apartment door.
Upon departure, the inventory and the state of cleanliness of the apartment will be subject to a check by CALM APPART HOTEL and any lack of inventory or damage caused to the apartment will be charged to the CLIENT.
CALM APPART HOTEL reserves the right to enter premises rented for maintenance or security.
Article 9 – RESPONSIBILITY
As this Convention is subject to the status of tourist residences, the provisions of Articles 1952 and following of the Civil Code relating to hoteliers are not applicable.
CALM APPART HOTEL can not be held liable in the event of theft or damage to personal belongings, in the apartments, including in individual chests, common rooms, car parks and all other outbuildings or annexes.
Article 10 – TERMINATION – SANCTIONS – NOT RENEWED BY CUSTOMER
The contract shall be terminated ipso jure, without formalities and without delay, in the event of non-performance by the Customer of any of its obligations or in abnormal and / or harmful behavior liable to disrupt the stay of other residents.
The Client will immediately leave the premises, failing which he will be expelled in the course of proceedings against him.
Article 11 – RESPECT FOR PRIVACY
The information of the collected personal information is transmitted voluntarily by the CLIENT as part of its reservation. This information is strictly confidential.
The CUSTOMER is informed that the automated processing of information, in particular the management of e-mail addresses, has been the subject of a declaration dated to the National Commission of Informatics and Liberties (CNIL) under the number :
In accordance with the Data Protection Act n ° 78-17, the CUSTOMER has a right of access, modification and deletions on the data concerning him. This right may be exercised with CALM APPART HOTEL 2, rue des Buisses 59000 LILLE.
Article 12 – RULES OF PROCEDURE
Rules of procedure are posted at the reception and in each accommodation.
Article 13 – LITIGATION
These General Terms and Conditions of Sale are governed by French law. If necessary, the court having jurisdiction in the event of a dispute shall be deemed to be the competent courts of the place of business CALM APPART HOTEL.
